This page provides an assessment guide for the Business Owner and Senior Executive visas (163/164). The information is drawn from DIAC’s information in Book 7. This guide is not meant to be a legal tool, it is intended to be used as a general guide that prompts the agent to assess the history and business skills profile of the applicant.
The result will assist the agent to decide if the applicant is worth putting through a more detailed assessment, in which case the agent should be referring to written policy and appropriate regulations.
Further assessment will still need to be done for quality of documents, health and character etc. It should be noted that the DIAC book does not comment on foreign Government employees and their (lack of) eligibility to apply. We understand that Government employees are specifically excluded from qualifying as Senior Executive.
This tool can help select the right State for an application for sponsorship, depending on the business profile. Updated versions (published later) will include an assessment option that covers business migration to other countries.
You can either click here to go to the Yes/No worksheet online, or you can download a more visual PDF flowchart. If your client is hampered by age or turnover shortfall, then if their English is at IELTS 5 level they may qualify for the business migration category for New Zealand (yes, we also do business plans for NZ). Click here to download the Australia v NZ assessment flowchart - remembering that this is also only a guide and does not represent proper immigration advice for either country.
