Sponsored Work

This visa take on different forms depending on how it is used. There are three areas we support:

  1. Where an offshore business is establishing a new branch in Australia and must provide a business proposal. The proposal must explain the Australian business opportunity and detail the operational need to sponsor a key employee to manage all of the business. (We support this with a business report)
  2. Where an existing Australian business wants to recruit offshore people to fill various employee positions and help the business grow. (Our business report summarises the employee development programmes and shows how the business could grow further with these “new recruits”.)
  3. Where a new Australian-owned business wants to recruit certain skilled offshore people to help the business grow. (This is a cross between the previous two, with the business report geared to profiling the original business managers, need for other skills and business plans for expansion.)

There are special immigration issues that we cannot assist with here, mainly relating to providing evidence that employees cannot be recruited form the local labour pool and the provision of organised professional training by the company.

If you as an agent are not well informed about these other requirements, we suggest you subcontract to another skilled immigration professional. If you are an applicant, we suggest you seek out professional advice from a qualified agent.

Where the original applicant has part owned or controlled the business, their 457 visa can feed into the EBA, REBA and Business Owner - Residence categories. The provisional Business Owner and Senior Executive categories do NOT feed into the EBA/REBA, just the 890/892 Business Owner Residence category.

There are several differences between the 457 and the Business Owner - Provisional categories, so it pays to think ahead before guiding your client to the first class of application.
